According to the complaint filed on behalf of Ms. Jayalalithaa Mr. Ganesan, Mr. Mathaian, Dharmapuri district secretary, and Vijaya Thayanban, women's wing secretary, made imputations against the Chief Minister, "lowering her moral character in the estimation of others and lowering her credit and image among the public and in the society at large". The three delivered speeches knowing that such statements would lower the reputation of the Chief Minister. Mr. Balachandar said the speeches constituted an offence under section 499 IPC (defamation by word, sign or visible representation), which was punishable under section 500 IPC (defamation against the President, Vice-President, Governor, administrator of the Union Territory or a Minister in respect of his/her conduct in the discharge of public functions). The judge ordered issue of summons to the three for appearance before the court on March 24.
