Councillors lash out at BMP Commissioner

BANGALORE Dec. 30. The Bangalore Mahanagara Palike (BMP) members on Monday lashed out at the Commissioner, M.R.Sreenivas Murthy, for nullifying several resolutions adopted by the previous Standing Committees after November 26 this year.

Questioning the validity of the resolutions, the Commissioner has sent over 100 files approved by the previous Standing Committees to the new standing committees for approval.

While the members, including the former chairman of the Works Committee, P.R.Ramesh, demanded an enquiry into the matter, the Commissioner questioned the validity of the resolutions as "they were adopted after the Committee's term expired".

Later, the Mayor, C.M.Nagaraj, ruled that all resolutions that were approved by the committees after November 26 would be placed before the Council for ratification. He asked the Council Secretary to withdraw all files from the new committees and hand them over to his office for examination. "The same will be placed before the Council for ratification," he said. Mr. Ramesh complained to the Mayor that the Commissioner had permitted his Committee to meet on November 29.

"How can you question the validity of the resolutions when the meeting was held with your approval? Why didn't you tell us that we could meet but not take any decisions?," he asked.

Earlier, raising the issue, Padmanabha Reddy (JD-U) and Mr. Ramesh sought to know as to why the Commissioner had nullified only 14 of the 161 files pertaining to various subjects approved by the committees after November 26.

"The Commissioner has sent back only 14 files to the Council Secretary with a note that `these files are not valid as they have been approved after the Committee's term expired on November 26'.

Whereas the remaining files pertaining to several works have gone up to the execution level.

There is a conspiracy behind this. We want a comprehensive enquiry into the matter," N.L.Narendra Babu, former chairman of the Taxation and Finance Committee, and Mr. Ramesh demanded.

M.K.Kuppuraj (JD-U) said the Commissioner or the Council Secretary should have informed the Chairpersons that they could not take any decision after November 26. "The officers have erred in this matter. The entire confusion is because of wrong guidance by the officers," he said.

Mumtaz Begum, former Chairperson of the Appeals Committee, said several resolutions adopted by her committee too were cancelled though they were taken before November 26.

In his reply, the Commissioner refuted the charges that he had sent back only 14 of 161 files to the new committees. "I have returned all files to the new panels without reference to the merits of the issues," he said.

Quoting sections from the Karnataka Municipal Corporations (KMC) Act, he said the Committee Chairmen could continue in office after his/her term of one year expired till the new Chairmen took over. "Whereas the members can't.

That's why any resolutions adopted after the one year period (even if they are taken at meetings approved by me) are null and void," he said.

Later, the Mayor adjourned the meeting to Tuesday and said "care will be taken that such instances will not repeat in future".
