Justice K. Balakrishnan Nair upheld the rule while dismissing a writ petition filed by some students of the University College of Teachers Education, Vaikom, who were doing their B.Ed. in Commerce. According to them, when they applied for the post, their applications had been rejected by the Public Service Commission on grounds that they did not possess B.Ed. qualification. The petitioners contended that the rule did not specify B.Ed. qualification for the same posts in aided schools. The rules insisted on holding only post-graduate degree with 50 per cent marks in respective subjects. Besides, those seeking appointment as teachers in language subjects did not need B.Ed. qualification. Dismissing the petition, the Court said the challenge against the rule was unsustainable.
