dated August 2, 1952: Preventive detention

Dr. Kailas Nath Katju moving for the consideration of the Select Committee's report on the preventive detention (second) Amendment Bill in the House of the People on August 1, said that the bill contained every possible precaution and safeguard one could possibly think of. If the House had accepted the principle of the preventive detention, as it had already done, the bill could be claimed to be, he said "a model piece of legislation", and he could confidently recommend to every section of the House to pass the bill "with their blessings."

The Home Minister said that normally if a bill was referred to a select committee, it was presumed that the House had agreed to the principle of the bill but in this particular case the members who became members of the committee declared that they were opposed to the bill root and branch, even the principle of the bill. None would be surprised, therefore, if they could not be satisfied.

The Speaker, Mr. Mavlankar, said that when the motion for reference to the Select Committee was put to vote to the House, certain members said that they had some mental reservations in regard to the principle of the bill.

The Speaker had then clarified the position that whatever mental reservations members had, so far the House was concerned, the acceptance of the motion as a whole meant that it was committed to the principle. There was no question of reopening the principle of the bill whatever one might say about details.
