Charges to be framed against Pritish Nandy

NEW DELHI JULY 16. A Delhi court today decided to frame charges against the Rajya Sabha member Pritish Nandy, who has been accused of assaulting an official at Delhi airport three years ago.

After hearing the arguments of prosecution and Mr Nandy's counsel, Additional Chief Metropolitan Magistrate, V.K. Maheshwari said "...I am of the view that there is prima facie evidence on the file to frame charges against the accused (Nandy) for the offence punishable under Section-186 (obstructing public servant in discharge of public function) and Section-353 (assault, or criminal force to deter public servant from discharge of his duty) of IPC''.

The court fixed July 27 for framing of charges. Police had filed a complaint alleging that on July 12, 1999, Mr Nandy who had to board a plane to Mumbai had picked up the security clearance stamp from the counter and stamped his boarding card on his own when the concerned staff delayed. The complaint alleged that when the official objected, the MP threatened him and said he would slap him.

Mr Nandy's counsel submitted that no offence under Section-353 was made out because there was no assault and the list of document mentioned in the report clearly indicate manupulation as there was over-writing on it.

However, public prosecutor contended that the complaint specifically mentioned that the official was pushed off and the accused threatened to slap him.

Accepting prosecution's submission, the court said "from this particular point, it is clear that the accused had pushed the complainant as per the allegation which is well within the definition of assault, hence offence under Section 353 IPC is made out''.
